The CNIL first of all emphasizes that the use of this pass “Can in no case be maintained beyond the health crisis”. She further believes “That the fact that the use of this pass is limited to events involving large gatherings of people, excluding in particular everyday activities (workplaces, restaurants, shops, etc.), makes it possible to limit breaches of the right to data protection and respect for the private life of individuals ”.

However, the CNIL asks the government to “Define in a precise manner, in the law, the purposes, the nature of the places, establishments and events concerned as well as the minimum attendance threshold envisaged and the methods of evaluation thereof”, according to the press release. This is to prevent unaffected professionals from being able to “Condition, on their own initiative, access” in certain places with the presentation of a health pass, she explains.
The principle of this pass is to be able to make access to certain places subject to presentation of a negative result of virological screening, proof of vaccination or a certificate of recovery following contamination. The government wants to impose it for large gatherings of 1,000 people, but without setting it in stone.

It is in particular because of the vagueness surrounding the implementation of this health pass that the MoDem deputies voted against the text on Tuesday, leading by a narrow majority to the rejection of the key article of the bill for the gradual exit of the state of emergency, which was nevertheless subsequently adopted in a new vote. The oppositions denounced infringements of public freedoms.
In terms of guarantees, the CNIL wants the health pass to limit “As far as possible the disclosure and retention of private information” and avoid “Any risk of discrimination, because of the state of health, but also because of the ability to access and use digital tools (possession of a smartphone, voluntary use of the TousAntiCovid application, etc.) “.
